Terms of Service

1. Acceptance of Terms

By accessing or using the Runpacks mobile application and website at runpacks.app (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

2. Eligibility

You must be at least 13 years old to use the Service. By using the Service, you represent and warrant that you meet this age requirement.

3. Account Registration

To use certain features, you must create an account using a valid email address. You are responsible for maintaining the security of your account and for all activity that occurs under it. You agree to notify us immediately at hello@runpacks.app if you suspect unauthorized access.

4. User Conduct

You agree not to:

• Use the Service for any unlawful purpose.
• Harass, threaten, or intimidate other users.
• Post content that is defamatory, obscene, or violates the rights of others.
• Impersonate another person or entity.
• Interfere with or disrupt the Service or its infrastructure.
• Attempt to gain unauthorized access to the Service or other accounts.
• Use automated means (bots, scrapers) to access the Service without our written consent.

We reserve the right to suspend or terminate accounts that violate these rules at our sole discretion.

5. User Content

You retain ownership of content you post to the Service (profile photos, pack descriptions, etc.). By posting content, you grant Runpacks a non-exclusive, worldwide, royalty-free license to use, display, and distribute that content in connection with operating the Service.

You are solely responsible for the content you post and must ensure it does not violate any third-party rights or applicable laws.

6. Packs and Real-World Activities

Runpacks facilitates organizing group running activities ("Packs"). Participation in any Pack is at your own risk. Runpacks is not responsible for any injuries, accidents, or damages that occur during Pack activities. You acknowledge that physical exercise carries inherent risks, and you participate voluntarily.

7. Premium Features and Payments

Certain features of the Service may require a paid subscription. Payments are processed by Stripe. By subscribing, you agree to Stripe's terms of service. Subscription fees are billed in advance and are non-refundable except as required by law.

We reserve the right to change pricing with reasonable notice. You may cancel your subscription at any time, and it will remain active through the end of the current billing period.

8. Intellectual Property

The Service, including its design, logos, and software, is the property of Runpacks and is protected by intellectual property laws. You may not copy, modify, distribute, or reverse-engineer any part of the Service without our written consent.

9. Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal data.

10. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not guarantee that the Service will be uninterrupted, error-free, or secure.

11. Limitation of Liability

To the maximum extent permitted by law, Runpacks shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability shall not exceed the amount you paid us in the twelve months preceding the claim.

12. Indemnification

You agree to indemnify and hold harmless Runpacks and its officers, directors, and employees from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.

13. Account Termination

You may deactivate or delete your account at any time from the Settings screen in the app. We may also suspend or terminate your account for violations of these Terms. Upon deletion, your personal data will be removed in accordance with our Privacy Policy.

14. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Continued use of the Service after changes constitutes acceptance of the revised Terms.

15. Governing Law

These Terms are governed by the laws of the Republic of Cyprus. Any disputes shall be resolved in the courts of Nicosia, Cyprus.
